Audiophile Style, LLC provides an ecommerce platform to purchase audio goods directly from sellers around the world. Whether you are looking for new or preowned audio components, headphones or music, we want you to have a positive experience shopping on Superphonica. Please read on to find out more about your rights, as well as what is expected of you, as a buyer.

1. Superphonica Limitations
Superphonica provides a venue for buyers to find, learn about, and enter into transactions with sellers around the world. It is important to note, however, that Superphonica is not a part of that transaction. By shopping on Superphonica, you understand that:

You are not buying directly from Superphonica, but from one of the many sellers on Superphonica;
Superphonica does not pre-screen sellers and therefore does not guarantee or endorse any items sold on Superphonica or any content posted by sellers (such as photographs or language used in listings or store policies);
Each seller on Superphonica accepts different payment methods and has their own processing times, shipping methods, and store policies.
As a member of the Superphonic community, you have the opportunity to flag an item or a store that violates any of Superphonica policies. Flagging is confidential. Please Contact Us to report incident.
2. Communicating with Other Superphonica Members
You’re required to use Superphonica’s Messaging tool to communicate directly with sellers or other Superphonica members. Superphonica Messaging is a great way to ask sellers any questions you have about an item or an order. Superphonica’s Messaging may not be used for the following activities:

Sending unsolicited advertising or promotions, requests for donations, or spam;
Harassing or abusing another member or otherwise violating our Anti-Discrimination Policy;
Contacting someone after they have explicitly asked you not to; or
Interfering with a transaction or the business of another member.
Interference occurs when a member intentionally interferes with another member’s store in order to drive away their business. Interference is strictly prohibited on Superphonica. Examples of interference include:

Contacting another member via Superphonica’s Messaging to warn them away from a particular member, store, or item;
Posting in public areas to demonstrate or discuss a dispute with another member;
Any use of Superphonica’s Messaging to harass other members is strictly prohibited. Similarly, conversations may not be used to support or glorify hatred or otherwise violate our Anti-Discrimination Policy.

3. Purchasing an Item on Superphonica
When you buy from a store on Superphonica, you’re directly supporting independent businesses and individuals, each with its unique listings, policies, processing times, and payment systems. By making a purchase from a seller on Superphonica, you agree that you:

Have read the item description and store policies before making a purchase;
Have submitted appropriate payment for item(s) purchased; and
Have provided accurate shipping information to the seller.
You also agree to comply with our Superphonica Payments Policy.
You can’t offer to buy or sell items outside of Superphonica. Our policies don’t cover transactions outside of our site. If you buy or sell items outside of Superphonica willingly, your account is subject to termination and potential reimbursement.
4. Leaving a Review of an Item
Reviews are a great way to learn about a seller’s items, help good sellers build a strong reputation, or help warn other buyers about a poor experience.

You can leave a review, including a one to five star rating of your purchase.

By leaving a review, you acknowledge that:

Your review and profile information will be publicly displayed on the seller’s listing and review pages.
Reviews may not:
Contain private information;
Contain obscene, racist, or harassing language or imagery;
Violate our Anti-Discrimination Policy;
Contain advertising or spam;
Be about things outside the seller’s control, such as a shipping carrier, Superphonica, or a third party; or
Undermine the integrity of the Reviews system.
Extortion is not allowed on Superphonica. Any attempt to manipulate reviews through threats, intimidation, or bribery is considered extortion and is strictly prohibited. Examples of extortion include the following:
A buyer leaves a negative review in an attempt to force the seller into providing additional items that were not agreed upon in the original transaction.
A buyer leaves a negative review in an attempt to force the seller into providing a refund when a refund is not warranted.
Shilling is not allowed on Superphonica. Shilling is the fraudulent inflation of a stores reputation by use of an alternate account. The intent of shilling is to make a seller look more desirable by increasing the stores number of sales and overall review score. Not only does it violate our core value of transparency, but it is considered to be a deceptive business practice by the US Federal Trade Commission. Reviews must reflect the honest, unbiased opinions, findings, beliefs, or experience of the buyer.
By uploading a photograph to Superphonica’s website, you warrant that:

You own the photograph or you have the rights or permission to use the photograph; and
You understand that, as stated in Superphonics Terms of Use, Superphonic has license to use any content you provide.
Sellers’ responses to reviews must also comply with this policy. Sellers may hide photographs that they do not feel accurately represent their brand, or they may report reviews that violate our Terms of Use. We reserve the right to remove reviews or photographs that violate our policies or Terms of Use.
5. Creating and Uploading Content
As a member of Superphonica, you have the opportunity to create and upload a variety of content, like Superphonica Messaging, text, photos, and videos. In order to keep our community safe and respectful, you agree that you will not upload content that is:

Abusive, threatening, defamatory, harassing, or otherwise in violation of our Anti-Discrimination Policy;
Obscene or vulgar;
In violation of someone else’s privacy or intellectual property rights; or
False, deceptive, or misleading.
6. Reporting a Problem with an Order or Returning an Item
We ask buyers to contact a seller directly and attempt to resolve any outstanding issues before contacting Superphonica. For this reason, it is important that you read and understand all seller store policies.

Buyers may report an incident for a non-delivery or a not-as-described item. Superphonica requires the seller to respond to any open incidents within seven days. Superphonica may use personal information for the purpose of resolving disputes with other members.

Ineligible Transactions

Some disputes don’t qualify for Superphonica’s involvement whatsoever. These include:

Items that have been purchased in person.
Intangible items, services, or prohibited items.
Transactions outside of Superphonica’s website where payment is not through, PayPal or Escrow.com.
Items that are returned without a return agreement.
Items that have been altered after receiving them.
Items that are received after the agreed-upon delivery date due to shipping delays.
Cost of shipping disputes.
When a dispute is ineligible, we encourage both parties to work together to come to an amicable solution.
Requesting a Cancellation
Only sellers may cancel transactions. Buyers may request that a seller cancel an order via Superphonica Messaging. Note that all cancellations must comply with our Anti-Discrimination Policy.
Returning an Item

Each seller has his or her own return policies, which should be outlined in their listings. Not all sellers accept returns. We encourage buyers to contact the seller and find out specifics before making a purchase. If items are damaged or not as described, seller must cover the return shipping costs. If you reside in the European Union, you may be entitled to a 14-day “cooling off period,” or a “right of withdrawal,” during which you may return an item for any reason.

7. Shipping
Each seller has his or her own shipping policies, which should be outlined in their listings. We recommend sellers use free shipping or flat rate shipping whenever possible. Furthermore, we encourage buyers to contact the seller and find out specifics before making a purchase. Superphonica requires all shipments process within 3 business days of receiving payment.

This policy is a part of our Terms of Use. By opening a Audiophile Style, LLC, you’re agreeing to this policy and our Terms of Use.

1. Types of Fees
Sellers may be required to pay the following types of fees:

Selling Fees

Superphonica charges 1% for each sold listing (not including shipping charges). There is no minimum fee and the maximum fee is $349. There is no time limit for listings and it can run until it sells. Superphonica reserves the right to change the Selling Fee percentage at any time without notice.

Transaction Fees

When you make a sale through Superphonica.com, you may be charged a transaction fee. The transaction fee will depend on the method of payment processing. This is a fee that payment processors (i.e. PayPal, Escrow.com, major credit cards) charge for its payment service separate and completely independent from Superphonica.

PayPal – 2.9% + $0.30 per transaction. credit & debit cards (Visa, Mastercard, Discover, American Express)
Escrow.com – Ranging from 3.25% – 0.89% deducted from the total sale amount. Other fees may apply.

Currency Conversion

All fees that appear on Superphonica are in US Dollars.

2. Fee Avoidance
Any action by a seller to avoid paying Selling Fees is considered fee avoidance and is strictly prohibited by Superphonica. This includes, for example, encouraging buyers to purchase an item in your Superhonica store through another venue. The price stated in each listing description must be an accurate representation of the sale. Sellers may not charge excessive shipping fees. Sellers may not alter the item’s price after a sale for the purpose of avoiding Superphonica Selling Fees, misrepresent the item’s location, or use another user’s account without permission.

3. Taxes
You are responsible for collecting and paying any taxes associated with using and making sales through Superphonica. When you sell physical goods on Superphonica and reside in the US or Canada, you have the option of either including applicable taxes in your listing prices, or excluding applicable taxes from your listing prices and separately calculating the tax owed on each sale.

If you sell physical goods on Superphonica and reside outside of the US and Canada, you need to include all applicable taxes in your listing prices.

Superphonica will issue 1099-K forms to certain sellers in the United States to comply with IRS requirements.

Please remember that Superphonica’s fees do not include any withholding taxes that might apply in your home country. You are required to pay Superphonica the full amount of our Selling Fees and may not deduct any applicable withholding taxes from that amount.

Audiophile Style, LLC allows buyers and sellers to use various forms of payments. Superphonica partners with PayPal and Escrow.com. This custom integration enables sellers to accept various forms of payment. Sellers registered on Superphonica.com, can accept payment by credit card, debit card, Escrow.com and PayPal. This policy explains all of your rights and obligations when using Superphonica payments. For your own protection, be sure to keep all communication on Superphonica’s website. This policy is a part of our Terms of Use. By using Superphonica.com, you’re agreeing to this policy and our Terms of Use.

1. Accepting These Terms
This document (the Superphonica Payments Policy or the “Policy,” for short) sets out your rights and responsibilities when you use Superphonica Payments, so please read it carefully. By using Superphonica Payments, you’re agreeing to the Policy. The Policy is a legally binding contract between you and Superphonica. The Superphonica Payments Policy is also a part of our Terms of Use. By using any of our Services, you’re agreeing to the Terms of Use.

2. Overview
Superphonica Payments enables sellers to accept various forms of payment. Sellers registered on Superphonica.com, can accept payment by credit card, debit card, Escrow.com and PayPal and have those funds deposited into a seller’s designated bank account.

Superphonica Payments is only available to sellers who are at least 18 years old and registered with Superphonica’s website. Superphonica Payments is currently available to sellers covered by PayPal and Escrow.com.

Sellers may only use Superphonica Payments for the sale of items listed on Superphonica’s website, and agree to ship sold items once a payment transaction is complete and reflected in their payment account. Superphonica reserves the right to terminate a seller’s access to Superphonica Payments if the seller uses Superphonica Payments in any other manner.
Buyers may authorize a payment with credit card, debit card, Escrow.com and PayPal.

3. Third-Party Services
Superphonica has engaged third-party service providers to perform many of the services related to payment processing, including card processing, currency exchange, identity verification, fraud analysis and regulatory compliance.

Superphonica partners with top tier licensed payment processors to facilitate card payments and other payments and the disbursement of funds to sellers. The provider and processing time for your payment will vary based on the country in which you’re located. If there are insufficient funds in your bank account when our provider processes the payment for your purchase, Seller reserves the right to contact you directly and to seek payment or withhold shipment until funds are available.

By using a third-party service, you may also be subject to an agreement with the third-party. For example, PayPal is a third-party service provided by PayPal Holdings, Inc. and is subject to the PayPal User Agreement.

If Superphonica receives notice that your Stores content or activity violates a third party’s service agreement, we may at our sole discretion take action against your account to comply with their policies. Such actions may include canceling a transaction, disabling listings from your store, suspending your selling privileges, or removing certain payment methods.

PayPal
Superphonica supports PayPal’s Adaptive Payments platform:

PayPal’s Adaptive Payments allow sellers to receive funds from PayPal purchases directly into their payment account, without the need to manage a separate PayPal account. This means that if a buyer pays with PayPal, the funds from the order will be credited to a seller’s payment account along with the rest of the orders. The standard Superphonica Selling Fee applies to orders that go through adaptive PayPal and applicable PayPal fees.

Escrow.com
Superphonica supports Escrow.com’s Platform API:

While traditional escrow service is quite difficult and must be obtained through banks and lawyers, Escrow.com provides online escrow services at affordable rates right on Superphonica’s site. While the payment is ‘In Escrow’ the transaction can be safely carried out without risk of losing money or merchandise due to fraud. An escrow is a financial arrangement where a third party holds and regulates payment of the funds required for two parties involved in a given transaction. Escrows are very useful in the case of a transaction where a large amount money is involved and a certain number of obligations need to be fulfilled before a payment is released like in the case of selling high-end audio components. The buyer might want confirmation the product delivered meets the ad description before making a full payment, and the seller doesn’t want to ship expensive gear without any assurance that he or she will receive payment.

4. Superphonica’s Rights and Responsibilities
Superphonica Payments functionality may be made available, modified, or discontinued by us at any time without notice and is subject to the limitations in Superphonica’s Terms of Use. Superphonica may refuse service of Superphonica Payments to anyone, for any reason, at any time.

5. Seller Rights and Responsibilities
Use of Superphonica Payments requires all transactions be conducted within Superphonica’s website. Transactions completed outside of Superphonica.com are prohibited and void security measures provided by Superphonica partners.
Disputes. Sellers agree to resolve any disputes directly with a buyer or with the assistance of the refund tools available through their payment processing company, and in accordance with our Terms of Use. In the event that a dispute is escalated to Superphonica’s support team, Superphonica reserves the right to require the seller to provide a refund to a buyer if a transaction is found to be in violation of Superphonica’s Terms of Use.
In the event that a buyer submits a chargeback, Superphonica will not intervene unless seller has violated Terms of Use. The seller agrees to resolve in good faith with buyer and settle dispute associated with buyer chargebacks.
Refund policies and procedures remain the sole responsibility of Seller. In the event that a dispute is escalated to Superphonica’s support team, Superphonica reserves the right to require the seller to provide a refund to a buyer if a transaction is found to be in violation of Superphonica’s Terms of Use.
International Trade Laws. You agree that your use of Superphonica Payments will not involve any countries, entities, individuals or items prohibited by sanctions, embargoes, regulations or orders administered by the US Department of Treasury’s Office of Foreign Assets Control (“OFAC”) or other government agencies.
6. Recoupment
We reserve the right, in our sole discretion, to seek reimbursement from a seller if the seller does not act in accordance with Superphonica’s Terms of Use or any policy thereunder.

9. Reporting Obligations
Internal Revenue Service regulations require that we file a Form 1099-K to report unadjusted annual gross sales information for sellers located in the United States or being paid in USD that meet both of the following thresholds in a calendar year (reporting):

More than $20,000 USD in gross sales, and (b) More than 200 transactions.
To comply with these regulations, sellers who approach 150 (one hundred and fifty) transactions in a calendar year, regardless of sales volume may be required to provide taxpayer-identification information to Superphonica.
10. Termination
Superphonica may terminate or suspend a seller’s use of Superphonica Payments at any time.

You can return many items you buy on Audiophile Style, LLC, depending on the seller’s return policy. Superphonica is a platform made up of independant sellers who may sell infrequently or operate their own stores through this site. Sellers are responsible for their own policies regarding refunds, exchanges, and returns. If items are not as described, the seller must cover the return shipping costs. Individual policies will vary from store to store. Not all sellers accept returns, but we recommend a minimum of 7 days after delivery. We encourage buyers to contact the seller and find out specifics before making a purchase.

Buyers
Before purchasing, it is best to locate and get familiar with the seller’s returns and exchanges policy. You can generally view this information within the listing description or Shipping & Return tab. Specific questions about a store policy are best answered by the seller. You can use Superphonica’s Messaging to contact the seller or Ask A Question from the seller’s store homepage before ordering to get clarification.

Returning an item

It’s important to have a return agreement with the seller before you ship an item back. This means you’ll want to ensure that you have the following:

Confirmation from the seller via Superphonica’s Messaging system that they’ll accept the return
A return shipping address provided by the seller
The timeframe in which the seller expects to receive the returned item
An agreement determining which party is responsible for the cost of return shipping (the buyer or the seller)
We also recommend holding on to all records of return shipment (like tracking information or a postal receipt) in case further action is required.
Issues with a transaction

Since each seller on Superphonica runs their own store, Superphonica is not directly involved in transactions between individual buyers and sellers.

This also means when you encounter an issue with a transaction (such as a non-delivery or an item not being as described), we ask that you first contact the seller directly to work towards a resolution. Because Superphonica is not directly involved in the transaction between buyers and sellers, we are unable to issue refunds for purchases.

While it’s our hope that both the buyer and seller will come to a mutual resolution, we can’t guarantee this will be the case. If you’re unable to get in touch with the seller, or work things out with them directly, the next step is Contacting Us. Please be aware that not all issues will be eligible for mediation.

Sellers
As a seller on Superphonica, you’re expected to clearly state your policies regarding returns and refunds in your store setup and we also recommend providing this information within the body of your listing descriptions. This includes:

Whether or not you accept returns
The time frame in which you may accept a return
Who will pay for the cost of return shipping for any items that are sent back to you
If you enter into a return agreement with a buyer via Superphonica’s Messaging system, we require you to fulfill that agreement. This may include:

Issuing a refund for the returned item(s)
Providing Superphonica with proof of shipping for a replacement item
If you do have a problem with a transaction, it’s best to contact the buyer directly via Superphonica’s Messaging system. Buyers are also encouraged to contact you if they experience any issues.
